CHEEKY MONKEYS — VR MULTIPLAYER GAME

These Terms of Service ("Terms") govern your access to and use of Cheeky Monkeys ("the Game"), developed and published by Avantos Games ("we", "us", "our"). By downloading, installing, or playing the Game, you agree to be bound by these Terms.
You must be at least 13 years old to play the Game. If you are between 13 and 18, you must have parental or guardian consent. The Game is designed for use with Meta Quest VR headsets. You are responsible for ensuring you meet the hardware requirements.
We grant you a limited, non-exclusive, non-transferable, revocable license to download and play the Game for personal, non-commercial entertainment purposes. This license does not transfer any ownership of the Game or its content to you.
Cheeky Monkeys is an independent fan-made game inspired by the locomotion mechanics popularized by Gorilla Tag. Avantos Games is not affiliated with, endorsed by, sponsored by, or connected to Another Axiom (the creators of Gorilla Tag) in any way. "Gorilla Tag" is a trademark of Another Axiom. All original content in Cheeky Monkeys is the intellectual property of Avantos Games.
While playing the Game, you agree not to:
— Harass, bully, threaten, or abuse other players in any way, including through voice chat, gestures, or gameplay behavior.
— Use hate speech, discriminatory language, or sexually explicit content.
— Cheat, hack, exploit bugs, or use unauthorized modifications that give you an unfair advantage or disrupt the game experience.
— Intentionally disrupt game sessions or grief other players.
— Impersonate Avantos Games staff or other players.
— Attempt to access, modify, or reverse-engineer the Game's source code, servers, or network infrastructure.
— Use the Game for any illegal purposes.
We reserve the right to suspend or permanently ban players who violate this Code of Conduct, at our sole discretion.
The Game includes online multiplayer features. You acknowledge that: we do not guarantee uninterrupted access to online services, we may perform maintenance that temporarily makes the Game unavailable, we are not responsible for the actions or behavior of other players, and online features may be modified or discontinued at any time.
All content in the Game — including but not limited to code, graphics, audio, music, game mechanics, maps, character designs, and the Avantos Games and Cheeky Monkeys branding — is owned by Avantos Games and protected by copyright and intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on the Game without our prior written consent.
If the Game allows you to create or share content (such as custom maps or cosmetics), you retain ownership of your original creations. However, by sharing content through the Game, you grant Avantos Games a worldwide, non-exclusive, royalty-free license to use, display, and distribute that content within the Game and related marketing materials.
Playing VR games involves physical movement and inherent risks. Please read our Health & Safety Disclaimer carefully before playing. By using the Game, you acknowledge that you understand and accept the physical risks associated with VR gaming. Avantos Games is not liable for any physical injury, property damage, or health issues that may occur during or as a result of playing the Game.
The Game is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Game will be error-free, secure, or continuously available. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, Avantos Games and its founders, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of data, personal injury, property damage, loss of profits, or any damages arising from your use of or inability to use the Game.
Our total liability for any claim related to the Game shall not exceed the amount you paid for the Game (if any).
You agree to indemnify and hold harmless Avantos Games from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Game, violation of these Terms, or infringement of any third-party rights.
We may terminate or suspend your access to the Game at any time, with or without cause, including for violations of these Terms. Upon termination, your license to use the Game is immediately revoked.
We reserve the right to update these Terms at any time. Continued use of the Game after changes constitutes acceptance of the updated Terms. For significant changes, we will provide notice through the Game or our website.
These Terms are governed by the laws of Belgium. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Belgium.
